The Wayne County Prosecutor’s Office has an Infraction Deferral Program for eligible drivers who are charged with certain infractions/traffic tickets.  The program allows drivers to have an infraction ticket dismissed if certain conditions are met.  The program is authorized by Indiana law at I.C. 35-28-5-1.

Speeding tickets (1 to 24 miles per hour over the speed limit), Disregarding a Stop Sign, and Failure to Use a Turn Signal are some common examples of infractions that may be eligible.  The facts and circumstances surrounding a particular ticket and /or an applicant’s poor driving record may disqualify a ticket from eligibility.   Certain offenses such as Operating a Vehicle without Financial Responsibility, Driving while Suspended, and Failure to Yield to an Emergency Vehicle are excluded from the program.
